β What are the different types of SFOCs?
Transport Canada issues different categories of Special Flight Operations Certificates (SFOCs) based on the complexity and risk level of the operation:
- SFOC β RPAS (Remotely Piloted Aircraft Systems): Required for drone operations exceeding standard regulations.
- SFOC β Beyond Visual Line of Sight (BVLOS): For long-range drone operations without direct visual contact.
- SFOC β Large RPAS (Over 25 kg): For operations involving drones exceeding 25 kg in weight.
- SFOC β Hazardous Payloads: Required when transporting hazardous materials, including flammable, toxic, or otherwise dangerous substances via drone.

β How do I apply for an SFOC?
The application process involves:
- Preparing a Concept of Operations (ConOps) document β A detailed plan outlining flight objectives, airspace considerations, risk mitigation strategies, and operational procedures. This document is critical for BVLOS and complex operations.
- Conducting an operational risk assessment β Identifying potential hazards, safety measures, and contingency planning.
- Submitting a detailed safety plan β Covering emergency procedures, pilot training, fail-safes, and aircraft specifications.
- Providing evidence of compliance β Demonstrating adherence to Transport Canadaβs technical and operational requirements.
- Applying through the Transport Canada RPAS portal β Depending on the SFOC type, applications may be submitted via the online portal or email.

β What's the approval timeline for an SFOC?
As per CAR 903.02, the SFOC-RPAS applicant is responsible for submitting all required additional information to the Minister at least 30 working days before the date of operation. It may take up to 60 working days to review and issue an SFOC-RPAS for higher-risk operations. Actual processing times can vary depending on the complexity and completeness of the request. Accepted SFOC-RPAS applications will be done in the order received. SFOC-RPASβs should be issued within the 60-working day window, assuming the applicant responds to additional requests in a timely manner. Additional processing time may be required by other agencies like the Transportation of Dangerous Goods Program, the Canadian Transportation Agency, and/or the Airspace Navigation Service Provider. SFOC-RPAS Application received with less then 30 working days advanced notice will not be accepted. If the requested window is longer term (say from today for 1 full year), the SFOC-RPAS application will be accepted.
A regional inspector may contact applicants for additional information during the review process.
β Can I get a standing SFOC for multiple flights?
Yes, Transport Canada offers standing SFOCs for ongoing operations in a specific area or category. These are typically granted to organizations with a strong safety record and proven operational capability.
β What happens if I operate a drone without an SFOC when one is required?
Operating a drone without an SFOC when one is required can lead to Transport Canada fines and penalties, including:
- Up to $25,000 in fines for individuals and businesses
- Legal action and loss of operating privileges
- Criminal charges for reckless endangerment
Please note that fines are cumulative and offenders may incur multiple fines within a single operation.
